Terms of Service
InjuryAid Effective Date: [Pending] Last Updated: [Pending]
ATTORNEY ADVERTISING. This website and the related messaging services are an advertisement for legal services provided by a partnered California law firm (to be announced). InjuryAid LLC. is an advertising and client-intake support company operating jointly with the Firm. InjuryAid LLC. is not a law firm and does not provide legal advice.
PLEASE READ THESE TERMS CAREFULLY. SECTION 16 CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED IN SECTION 16.8.
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and InjuryAid LLC, a limited liability company doing business as Injury Aid ("Injury Aid," "we," "us," or "our") governing your use of our website at injuryaid.co (the "Site"), our WhatsApp and SMS/text messaging channels, our automated intake assistant, and any related services (collectively, the "Services").
By accessing the Site, messaging us, checking a consent box, or otherwise using the Services, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
Our partner law firm (the "Firm") is not a party to these Terms, but is an intended third-party beneficiary of Sections 2, 5, 6, 9, 13, 14, 15, and 16, and may enforce those Sections directly.
2. Important Disclosures — Read This Section First
2.1 Who We Are and How This Works
Injury Aid is a marketing, advertising, and intake-support company. We advertise jointly with the Firm under California's provisions permitting group and joint advertising by attorneys (California Business and Professions Code section 6155 and related law). Our role is to (a) run advertising that identifies the Firm, (b) operate a conversational intake that gathers the information the Firm needs, and (c) if you meet the Firm's screening criteria, arrange the callback you requested from the Firm. We advertise for one law firm only — the Firm — and we do not refer, distribute, sell, or broker inquiries among multiple law firms. We are not a State Bar–certified lawyer referral service and do not hold ourselves out as one.
2.2 Compensation Disclosure
Using the Services is free to you. Injury Aid is compensated by the Firm through a flat advertising and marketing budget. Injury Aid's compensation is not contingent on whether you hire the Firm, whether the Firm accepts your matter, or the outcome or value of any case. Injury Aid does not receive, and will not accept, any portion of any legal fee or recovery. Any fee arrangement for legal services is exclusively between you and the Firm, documented in a written agreement you would sign with the Firm.
2.3 No Attorney–Client Relationship; No Legal Advice
No attorney–client relationship is created by using the Services — not by visiting the Site, messaging our assistant, submitting the contact form, sending documents, being marked "qualified," or scheduling a callback. An attorney–client relationship with the Firm is formed only if and when you and the Firm sign a written engagement agreement after you speak with the Firm. The Firm is under no obligation to accept any matter, and Injury Aid has no authority to accept clients, make promises, or provide legal advice on the Firm's behalf.
Nothing on the Site or in our conversations is legal advice. Content is general information and advertising only. Do not act or refrain from acting based on anything in the Services without obtaining advice from a licensed attorney about your specific situation.
2.4 Your Communications With Injury Aid Are Not Privileged
Communications with Injury Aid — including with our automated assistant and our staff — are not protected by the attorney–client privilege or the attorney work-product doctrine, because Injury Aid is not a law firm and no attorney–client relationship exists at that stage. We treat your information as confidential under our Privacy Policy, but a privacy commitment is not legal privilege. Please limit what you share with us to what the intake questions ask for, and save detailed or sensitive case discussions for your conversation with the Firm.
2.5 Automated Assistant Disclosure
The intake conversation is conducted by an automated virtual assistant (a bot), not a human, and it is disclosed as such at the start of every conversation. The assistant uses artificial intelligence to understand and respond to messages and may occasionally misunderstand or make mistakes. Its answers are drawn from pre-approved content, and its screening results are preliminary and administrative — they are not legal determinations. Conversations are recorded, stored, and may be reviewed by human staff. You may request a human at any time.
2.6 Screening Is Not a Legal Evaluation; a "No" Is Not an Opinion About Your Case
Our assistant asks a fixed set of screening questions supplied by the Firm to determine whether your inquiry fits the categories of matters the Firm is currently accepting through this channel. This screening is not an evaluation of the legal merits of your potential claim. If we tell you that we are unable to help you at this time, that message means only that your inquiry does not fit this program's current intake criteria. It is not legal advice, not an opinion that you do not have a valid claim, and not a prediction about what any lawyer or court would conclude. Other attorneys may evaluate your situation differently and may be willing to take your case. If your inquiry is not accepted, we strongly encourage you to promptly contact other attorneys or the State Bar of California's certified lawyer referral services.
2.7 Deadlines Are Running — Do Not Wait
Strict time limits (statutes of limitations and claim-presentation deadlines) apply to injury claims. In California, many personal-injury claims must be filed within two years of the injury, and claims against government entities generally require a written claim within six months — and other deadlines can be shorter or different depending on the facts. Nothing about the Services pauses, extends, or protects any deadline. Messaging us, sending documents, scheduling a callback, or waiting for a callback does not stop time from running on your claim. If you are close to a deadline, or do not know your deadline, contact a licensed attorney immediately.
2.8 No Guarantees, Predictions, or Promises of Results
Neither Injury Aid nor the Firm guarantees, warrants, or predicts the outcome, value, or timing of any legal matter. Every case is different, results depend on facts and law specific to each matter, and prior results do not guarantee a similar outcome. Any statement in our advertising about costs or fees (for example, that clients pay nothing out of pocket) is a summary of the Firm's standard contingency arrangement; the complete terms, including responsibility for case costs, are stated in the Firm's written engagement agreement, which you should read before signing. Nothing in the Services promises quick payment or a fast settlement.
2.9 Emergencies and Medical Care
If you are experiencing an emergency, call 911. The Services are not for emergencies and are not medical advice. Any suggestion in our conversation to seek medical care (for example, visiting urgent care after a recent accident) is general safety information, not a medical opinion. Decisions about your health are between you and your medical providers.
2.10 Mock Conversations and Illustrations
Screenshots, sample chats, illustrations, and mascot characters (including "Barry") appearing in our advertising are illustrative dramatizations, are labeled as such where they appear, and do not depict real clients or real conversations unless expressly stated with the person's written consent.
3. Eligibility
To use the Services you must: (a) be at least 18 years old; (b) be inquiring about a matter in California for yourself or as the parent/legal guardian or authorized representative of the injured person; and (c) provide information that is true, accurate, and complete to the best of your knowledge. If a minor was injured, only a parent or legal guardian may use the Services on the minor's behalf. We may decline, limit, or discontinue service to anyone at our discretion, consistent with applicable law.
4. Description of the Services
The Services consist of: advertising for the Firm; a conversational intake over WhatsApp, SMS, or the Site; collection of the information and documents described in our Privacy Policy; preliminary administrative screening against the Firm's criteria; transmission of qualifying inquiries to the Firm; and scheduling of a callback from the Firm. The Services are provided "as available." We may modify, suspend, or discontinue any part of the Services at any time. Screening criteria are set by the Firm, are proprietary, may change without notice, and — as stated in Section 2.6 — are not legal standards or legal advice.
5. Consent to Be Contacted (Calls, Texts, and WhatsApp)
5.1 Your Consent
By submitting your phone number through the Site's form after checking the consent box, or by initiating a conversation with us by SMS or WhatsApp, you expressly consent to receive calls and messages about your inquiry — including autodialed and prerecorded/artificial-voice calls and automated texts — from Injury Aid Co. and the Firm at the number you provided. The Site's consent language reads substantially as follows:
"I agree to receive text messages from InjuryAid about my inquiry at the number provided. Message & data rates may apply. Reply STOP to opt out. Consent is not a condition of hiring."
Consent is not a condition of purchasing anything or of hiring the Firm. Message and data rates may apply. Message frequency varies with your conversation.
5.2 Revoking Consent
You may revoke consent at any time: reply STOP to any text; tell us to stop in any conversation or call; or email info@injuryaid.co. We honor revocations made by any reasonable method, promptly and in all events within 10 business days, and we maintain suppression records so you are not re-contacted. Reply HELP for help. Opting out ends messaging but does not delete your record; deletion is handled under the Privacy Policy.
5.3 Accuracy of the Number; Recording
You represent that you are the subscriber or customary user of the phone number you provide and that you will notify us if you relinquish it. Calls with our team or the Firm's team may be monitored or recorded for quality and compliance; where recording occurs you will be notified at the start of the call as California law requires.
5.4 Electronic Communications and Signatures
You consent to receive disclosures, notices, and records from us electronically (by message, email, or posting to the Site), and you agree that checking a box, tapping a button, or replying in a conversation constitutes your electronic signature with the same effect as a handwritten signature. You may withdraw this consent, or request paper copies, by contacting info@injuryaid.co; withdrawing may prevent us from providing the Services.
6. Messaging Program Terms (SMS and WhatsApp)

- WhatsApp. WhatsApp messaging is provided via Meta's WhatsApp Business Platform and is additionally governed by WhatsApp's own terms and policies. We are not responsible for the WhatsApp service itself.
7. Information and Documents You Submit
7.1 Your Representations
For all information, messages, photos, and documents you submit ("Submissions"), you represent and warrant that: (a) the Submissions are true, accurate, and complete to the best of your knowledge; (b) you have the legal right to share them, including any information about other people (such as another driver's insurance details obtained through a lawful post-accident exchange or police report); (c) the Submissions do not infringe any third party's rights or violate any law; and (d) you are not submitting information on behalf of another adult without their authorization.
Providing false information to obtain legal services or in connection with an insurance claim can be a crime. We may decline or discontinue service, and may notify the Firm, if we believe information is false or an inquiry is fraudulent, abusive, or submitted in bad faith.
7.2 License to Use Submissions
You retain ownership of your Submissions. You grant Injury Aid a limited, non-exclusive, royalty-free license to host, store, reproduce, process (including with the AI systems described in Section 2.5 and the Privacy Policy), and transmit your Submissions solely to operate the Services, conduct intake, transmit your inquiry to the Firm, maintain records, comply with law, and enforce these Terms. This license does not permit us to use your Submissions in advertising or for any marketing purpose, and it ends when your data is deleted under our retention schedule or your verified deletion request, except for records we must keep by law.
7.3 What Not to Send
Do not send Social Security numbers, financial account or card numbers, passwords, or complete medical records — we do not request them and will ask you to stop if you send them. Do not send content that is unlawful, threatening, or unrelated to your inquiry.
8. Acceptable Use
You agree not to: (a) use the Services for any unlawful purpose or in violation of these Terms; (b) submit false, misleading, or fraudulent information or impersonate any person; (c) probe, scan, or test the vulnerability of our systems, bypass security or authentication measures, or access data not intended for you; (d) scrape, harvest, or collect data from the Services, or use robots, spiders, or automated tools to access the Services other than as a natural person conducting your own inquiry; (e) interfere with or disrupt the Services, including by flooding, spamming, or introducing malicious code; (f) attempt to manipulate, prompt-inject, reverse-engineer, extract prompts or models from, or misuse the automated assistant; (g) use the Services to develop a competing product or to test or benchmark AI systems; or (h) use another person's identity or phone number without authorization.
9. Intellectual Property
The Services and all content we provide — including text, graphics, page designs, the "Injury Aid" name and logos, and the "Barry" mascot character and related artwork — are owned by Injury Aid or its licensors and are protected by intellectual-property laws. The Firm's name and marks belong to the Firm. We grant you a limited, revocable, non-transferable license to access and use the Site for your personal, non-commercial use in connection with your inquiry. No other rights are granted. Feedback you voluntarily provide about the Services may be used by us without restriction or compensation.
If you believe content on the Site infringes your copyright, send a notice compliant with 17 U.S.C. § 512 to our designated agent at info@injuryaid.co (subject "DMCA Notice"), 7901 4th St N, Ste 300, St. Petersburg, FL 33702.
10. Third-Party Platforms and Links
The Services operate on and link to third-party platforms (including WhatsApp/Meta, SMS carriers, Instagram, and Facebook). Your use of those platforms is governed by their own terms and policies. We do not control and are not responsible for third-party platforms, their availability, or their content.
11. Privacy
Our collection and use of personal information is described in the Privacy Policy, which is part of these Terms. Key points: we do not sell personal information or leads; your inquiry is shared only with the Firm and our service providers; and mobile opt-in data and consent are never shared with third parties.
12. Changes to the Services and These Terms
We may update these Terms from time to time. The "Last Updated" date reflects the current version. Material changes will be posted conspicuously on the Site and, where you have an active conversation with us, noted in that channel. Changes apply prospectively from posting; your continued use of the Services after changes take effect constitutes acceptance. If you do not agree to a change, stop using the Services. Section 16 (Dispute Resolution) changes will not apply to disputes of which we had written notice before the change.
13. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WITHOUT LIMITING THE FOREGOING, INJURY AID DOES NOT WARRANT OR GUARANTEE THAT: (A) THE FIRM WILL CONTACT YOU WITHIN ANY PARTICULAR TIME OR AT ALL, OR WILL ACCEPT YOUR MATTER; (B) THE AUTOMATED ASSISTANT'S RESPONSES OR SCREENING RESULTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR RELIANCE; (C) MESSAGES WILL BE DELIVERED, TIMELY, OR SECURE; OR (D) THE SERVICES WILL MEET YOUR NEEDS. YOU ARE SOLELY RESPONSIBLE FOR PROTECTING YOUR LEGAL RIGHTS AND DEADLINES, INCLUDING BY PROMPTLY CONSULTING A LICENSED ATTORNEY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NEITHER INJURY AID NOR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR SERVICE PROVIDERS, NOR THE FIRM IN ITS CAPACITY AS AN ADVERTISER THROUGH THE SERVICES, WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOSS OF DATA, OR THE VALUE OF ANY LEGAL CLAIM (INCLUDING ANY CLAIM ALLEGED TO BE IMPAIRED BY A MISSED DEADLINE), ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) INJURY AID'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) (YOU PAY NOTHING TO USE THE SERVICES).
NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY FOR GROSS NEGLIGENCE, FRAUD, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER CALIFORNIA LAW (INCLUDING CALIFORNIA CIVIL CODE SECTION 1668), AND NOTHING IN THESE TERMS LIMITS ANY NON-WAIVABLE RIGHT YOU HAVE AS A CONSUMER. IN JURISDICTIONS THAT DO NOT ALLOW CERTAIN LIMITATIONS, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED. THE LIMITATIONS IN THIS SECTION ARE A FUNDAMENTAL BASIS OF OUR PROVIDING THE SERVICES FREE OF CHARGE.
15. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Injury Aid and its owners, officers, employees, contractors, and service providers, and the Firm, from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your Submissions, including any claim that information you provided about another person was unlawfully obtained or shared; (b) your violation of these Terms or of any law; or (c) your fraudulent or bad-faith use of the Services. This Section does not require you to indemnify any party for that party's own negligence or misconduct, and does not apply to the extent prohibited by law.
16. Dispute Resolution — Binding Arbitration and Class Action Waiver
Please read this Section carefully. It affects your rights. You can opt out (Section 16.8).
16.1 Informal Resolution First
Before filing any claim, you and we each agree to first send the other a written notice of dispute describing the claim and the relief sought (to us: info@injuryaid.co or 7901 4th St N, Ste 300, St. Petersburg, FL 33702; to you: your email or phone number on file), and to negotiate in good faith for 60 days. Most concerns can be resolved this way. The statute of limitations and any filing-fee deadlines are tolled during this 60-day period.
16.2 Agreement to Arbitrate
Except as provided in Sections 16.3 and 16.6, you and Injury Aid agree that any dispute, claim, or controversy arising out of or relating to the Services, these Terms, our communications with you, or your inquiry (each, a "Dispute") — including Disputes with the Firm arising out of communications made through the Services, but excluding any dispute arising under a separate written engagement agreement between you and the Firm, which is governed by that agreement — will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and its Consumer Arbitration Minimum Standards, before a single neutral arbitrator, rather than in court. The Federal Arbitration Act governs this Section. Judgment on the award may be entered in any court of competent jurisdiction.
16.3 Exceptions
Either party may (a) bring an individual claim in small claims court in a court of competent jurisdiction, and (b) seek temporary injunctive relief in court to stop unauthorized use or abuse of the Services or infringement of intellectual-property rights, pending arbitration. In addition, nothing in this Section waives your right, if any, to seek public injunctive relief in court where California law makes that right non-waivable; any such claim shall be stayed pending arbitration of all arbitrable claims.
16.4 Costs of Arbitration
Arbitration will take place in the county where you reside in California, remotely by video, or at another mutually agreed location. Your filing fee will not exceed the amount required by JAMS's Consumer Minimum Standards (currently US $250), and we will pay all other JAMS fees and arbitrator costs. Each party bears its own attorneys' fees except where the arbitrator awards them under applicable law. If the arbitrator finds a claim frivolous or brought in bad faith, fees may be allocated as the JAMS rules and applicable law allow.
16.5 Class Action and Jury Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND INJURY AID EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, REPRESENTATIVE, OR CONSOLIDATED ACTION OR ARBITRATION. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party's individual claim. If this class waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and all other claims shall remain in arbitration.
16.6 Mass Arbitration Procedures
If 25 or more demands with common issues are filed by or with the assistance of coordinated counsel, the parties agree that the demands will be administered in staged batches under JAMS's mass-arbitration procedures (or, absent such procedures, in batches of up to 25 selected proportionally by each side), with early bellwether proceedings and a mediation session after the first batch, before remaining demands proceed. Filing and administrative fees for un-batched demands are deferred until their batch begins. This Section is intended to promote efficient, good-faith resolution and shall be interpreted to be enforceable under applicable law.
16.7 Delegation and Severability
The arbitrator shall decide all issues, including arbitrability and the scope and enforceability of this Section, except that only a court may decide the enforceability of the class waiver in Section 16.5 and issues concerning public injunctive relief in Section 16.3. If any part of this Section 16 is found unenforceable, the remainder shall remain in effect.
16.8 Your Right to Opt Out
You may opt out of this arbitration agreement and class waiver, without any penalty or effect on the Services, by emailing info@injuryaid.co (subject line: "Arbitration Opt-Out") or mailing us at 7901 4th St N, Ste 300, St. Petersburg, FL 33702 within 30 days of first accepting these Terms, stating your name, phone number used with the Services, and that you opt out of arbitration. Opting out does not affect any other provision of these Terms.
17. Governing Law; Venue; Time Limit on Claims
These Terms and any Dispute are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-laws rules. For any matter not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California, and each party waives objections to that venue. To the extent permitted by applicable law, any claim arising out of or relating to the Services must be commenced within one (1) year after the claim accrues, or it is permanently barred; this limitation does not apply to claims that by law cannot be shortened, and nothing in it shortens any deadline applicable to your underlying injury claim, which is governed by the statutes described in Section 2.7.
18. Suspension and Termination
You may stop using the Services at any time (see Section 5.2 to stop messages). We may suspend or terminate your access to the Services at any time, with or without notice, including for violations of these Terms, suspected fraud, abusive conduct, or legal or compliance reasons. Sections that by their nature should survive (including Sections 2, 5.4, 7, 9, 13–17, 19, and 20) survive termination.
19. Advertising Complaints and State Bar Process
We take advertising compliance seriously. Our advertising is operated jointly with the Firm under a documented review-and-approval process, and we maintain the ability to modify or withdraw any advertisement promptly.
- To raise a concern about our advertising, contact info@injuryaid.co or 7901 4th St N, Ste 300, St. Petersburg, FL 33702, attention "Advertising Compliance." We review complaints promptly and will respond.
- You also have the right to file a complaint about attorney advertising directly with the State Bar of California (www.calbar.ca.gov). Under California law (Business and Professions Code sections 6156.5–6158.7, as amended effective January 1, 2026), the State Bar reviews such complaints, and advertisers who receive notice of a substantiated complaint may withdraw the advertisement. We and the Firm will comply with any such process, including prompt withdrawal where required.
20. General Provisions
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Injury Aid regarding the Services and supersede prior or contemporaneous understandings regarding the Services. They do not modify, and are subordinate to, any written engagement agreement you sign with the Firm as to the subject matter of that agreement.
- Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in full effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets, consistent with the Privacy Policy.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including carrier or platform outages.
- Headings; interpretation. Headings are for convenience only. "Including" means "including without limitation."
- Notices. We may provide notices via the Site, the messaging channel you used, or the email you provided. Notices to us go to info@injuryaid.co or 7901 4th St N, Ste 300, St. Petersburg, FL 33702.
- California consumer notice. Under California Civil Code § 1789.3, California users are entitled to know that complaints may be filed with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at (800) 952-5210.
